COTALAND Ticketing, Admission & Park Terms and Conditions

These Ticketing, Admission & Park Terms and Conditions (“Ticket Terms”) govern the purchase, possession and use of Tickets and Passes (each as defined below) for admission to the COTALAND theme park and related facilities located on the Circuit of the Americas campus in Austin, Texas (“Park”). These Ticket Terms are posted on the COTALAND website and applied at the time of purchase and/or entry.

By purchasing, accepting, possessing or using any Ticket or Pass, and/or by entering the Park, you agree to be bound by these Ticket Terms and the Park Rules. If you do not agree, do not purchase or use a Ticket or Pass and do not enter the Park.

IMPORTANT NOTICE: THESE TICKET TERMS INCLUDE A RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY OBLIGATIONS THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ CAREFULLY.

1. Parties; Definitions

These Ticket Terms are issued by COTA Yellow Brick Road LLC (“COTALAND,” “we,” “us,” or “our”). Key definitions used in these Ticket Terms:

• “COTALAND Parties” means COTA Yellow Brick Road LLC, Circuit of the Americas LLC, and each of their respective affiliates, parent entities, subsidiaries, owners, members, managers, officers, directors, employees, agents, representatives, contractors, vendors, sponsors, licensors, and assigns.
• “Ticket” means any admission ticket (including dated and undated tickets), reservation, digital credential, wristband, barcode, QR code or other admission medium issued by or on behalf of COTALAND for entry to the Park.
• “Pass” means any season pass, annual pass, membership, or other multi-visit admission product issued by or on behalf of COTALAND.
• “Reservation” means any required booking, date selection, entry time selection, or other pre-arrival capacity management mechanism, whether made through the website, mobile application, customer service, or on-site.
• “Blackout Date” means any date on which certain Tickets or Passes are not valid for Park entry, including due to (i) major events or other activities on the campus, (ii) special events, concerts, private buyouts, filming, or (iii) capacity, operational, safety, staffing, maintenance or other considerations, as determined by COTALAND in its sole discretionand updated from time to time.
• “Park Rules” means the Park Policy (including the Code of Conduct) and any additional rules, policies, restrictions, safety requirements, prohibited items list, guest services policies, and similar requirements posted on the COTALAND website, mobile app, signage at the Park, or otherwise communicated by COTALAND, as updated by COTALAND from time to time.

2. Ticketing Products and Offerings

The following is an overview of the current ticketing and admission products and related add-ons that may be offered through COTALAND. Product names, pricing and benefits are subject to change from time to timeThe details below are included for convenience only; these descriptions are subject to the reminder of the Ticket Terms.

Any Day Ticket

General one-day admission ticket that is valid for a single day of entry during the applicable validity window. Valid for one (1) day of Park entry during the applicable validity period, subject to capacity and operational availability.

• Subject to Blackout Dates and other restrictions posted from time to time.
• Applicable taxes, service fees, and other charges may apply in addition to the listed price.

Choose Your Day Ticket (Dated Ticket)

One-day admission ticket that is valid only on the date selected at the time of purchase and may be priced based on expected demand.

• Valid only for the specific date selected, and only for one (1) day of entry, subject to capacity and operational availability.
• May require and/or constitute a Reservation for the selected date; additional Reservations may be required from time to time.
• Subject to Blackout Dates and other restrictions posted from time to time.
• Applicable taxes, service fees, and other charges may apply in addition to the listed price.

Two-Day Ticket

Admission ticket that provides two days of Park entry during the applicable validity period, subject to use requirements disclosed at purchase.

• Valid for two (2) days of Park entry within the applicable validity period, subject to capacity and operational availability.
• Second visit must be used within seven (7) days of the first visit date.
• Subject to Blackout Dates and other restrictions posted from time to time.
• Applicable taxes, service fees, and other charges may apply in addition to the listed price.

Season Pass

A multi-visit admission product valid for a defined season, subject to Pass rules and any applicable Reservations or Blackout Dates.

• Unlimited or multi-visit entry during the defined season (as specified at purchase), subject to capacity and any required Reservations.
• Subject to Blackout Dates and other restrictions posted from time to time.
• Benefits (if any) such as discounts, events, parking, and similar perks are subject to change and may be limited by availability.
• Applicable taxes, service fees, and other charges may apply in addition to the listed price.

Annual Pass

A multi-visit admission product valid for a defined 12-month period (or other stated term), subject to Pass rules and any applicable Reservations or Blackout Dates.

• Valid for Park entry for the applicable term stated at purchase, subject to capacity and any required Reservations.
• Subject to Blackout Dates and other restrictions posted from time to time.
• Benefits (if any) are described at purchase and are subject to change and availability.
• Applicable taxes, service fees, and other charges may apply in addition to the listed price.

Annual Pass Plus / VIP Annual Pass

A premium annual pass tier that may include enhanced benefits (e.g., preferred parking) as described at purchase.

• Valid for Park entry for the applicable term stated at purchase, subject to capacity and any required Reservations.
• Subject to Blackout Dates and operational restrictions as published from time to time.
• Premium benefits (e.g., preferred parking) are subject to availability and may be modified or discontinued.
• Applicable taxes, service fees, and other charges may apply in addition to the listed price.

Annual Pass Membership (Monthly Payment Plan)

If offered, a Pass purchase/payment option that allows payment over time (e.g., initial deposit followed by monthly installments), subject to payment plan terms and eligibility.

• Requires an initial deposit and then twelve (12) monthly payments, with total obligations and timing disclosed at purchase.
• If payments fail or the plan is cancelled/terminated for non-payment, access may be suspended and the Pass may be voided at COTALAND’s sole discretion.
• Payment plans are subject to additional terms provided by the payment processor and/or financing provider.

Annual Pass Plus Membership (Monthly Payment Plan)

If offered, a premium Pass payment plan option that allows payment over time for the Annual Pass Plus product, subject to payment plan terms and eligibility.

• Requires an initial deposit and then twelve (12) monthly payments, with total obligations and timing disclosed at purchase.
• Non-payment may result in suspension or termination without refund, subject to applicable law.
• Payment plans are subject to additional terms provided by the payment processor and/or financing provider.
• Premium benefits remain subject to availability and change.

Optional Add-Ons (if offered at purchase):

• Parking Passes (standard or preferred parking).
• All-day dining, meal plans, or similar food & beverage packages (subject to participating locations, blackout items, and redemption limits).
• Line-skipping / expedited access products (e.g., “Podium Pass”) subject to ride availability, time windows, and operational restrictions.
• Reusable drink bottles and beverage programs subject to redemption limits and participating locations.

3. Reservations; Capacity; No Guarantee of Admission

Entry to the Park is subject to capacity, availability, operational hours, safety requirements, maintenance schedules, staffing, weather conditions, special events, and other factors. COTALAND may require Reservations for certain Ticket or Pass types, on certain dates, or during certain time windows.

Even if you hold a Ticket or Pass, admission is not guaranteed on any particular date or time unless COTALAND expressly confirms a Reservation for that date/time and the Reservation remains valid at the time of entry.

Reservations are limited and may be modified or cancelled by COTALAND at any time. Reservations may be void if transferred or sold, have no cash value, and may expire at the end of the applicable date if unused.

Reservation No-Shows; Abuse. COTALAND may limit the number of active Reservations per guest or account and may impose rules regarding cancellation timing. Repeated no-shows, late cancellations, misuse, or other Reservation “abuse” (as determined by COTALAND in its sole discretion) may result in fees where permitted by law, restriction of Reservation access, suspension of Pass/Membership benefits, and/or cancellation of Tickets/Passes without refund.

4. Blackout Dates; Special Events; Campus Activity Conflicts

Certain dates may be designated as Blackout Dates for some or all Ticket or Pass types. Blackout Dates may be determined and published by COTALAND from time to time in COTALAND’s sole discretion and may include Special Events (as defined below), COTA Events (as defined below), concerts, private events, Park buyouts, filming, and other campus activities.

COTALAND may host seasonal or other special events from time to time (each, a “Special Event”). Some Special Events may be designated as Blackout Dates (in which case, Any Day Tickets and Annual Passes will not grant admission). Other Special Events may coincide with activities or events at Circuit of The Americas (including but not limited to the Formula 1 United States Grand Prix) (each, a “COTA Event”). During certain COTA Events, the Park will not be accessible without a ticket to the COTA Event. These COTA Events will be marked as Blackout Dates and require purchase of admission to the COTA Event and a COTALAND upgrade or wristband to access available COTALAND attractions.

COTALAND may add, remove, or change Blackout Dates (including after a Ticket, Pass, or Reservation is purchased or made). Changes to Blackout Dates and/or reservation availability will not entitle any guest, passholder, member, or reservation-holder to a refund, chargeback, damages, or any other compensation.

If a date becomes unavailable due to a newly designated Blackout Date or other restriction, COTALAND may in its sole discretion, either cancel the reservation or permit rebooking to an alternate date, subject to availability and any difference in pricing or fees. This will be your sole remedy in the case of a change of ticket availability. In no circumstances will COTALAND be responsible for any indirect or consequential damages due to a change in ticket availability.

5. Ticket and Pass Restrictions; Transfer; Resale

Tickets and Passes are issued as revocable licenses to enter the Park subject to these Ticket Terms and the Park Rules. Unless expressly permitted in writing by COTALAND, Tickets and Passes are non-transferable and not for resale.

Same-Person Use; Identity Verification. Tickets and Passes may only be used by the individual to whom they are assigned/issued (including the individual who first uses the Ticket/Pass, where applicable). Photo identification may be required for entry, re-entry, benefit redemption, or verification. COTALAND may require a photo capture of the Ticket/Pass holder and may deny entry or benefits if identity cannot be verified.

Admission Media; Property. Tickets/Passes (including wristbands, digital credentials, and barcodes/QR codes) may remain the property of COTALAND (or its ticketing providers) to the maximum extent permitted by law and may be confiscated, disabled, or canceled for misuse or violations of these Ticket Terms or Park Rules.

Tickets or Passes that are resold, offered for resale, transferred for profit or commercial gain (including as part of a promotion or prize), obtained from unauthorized sellers, or otherwise used in violation of these Ticket Terms may be voided without refund and the holder may be denied entry or removed from the Park.

Void Tickets; Fraud; Tampering. Tickets/Passes are void if altered, duplicated, counterfeited, obtained by fraud, or used in a manner inconsistent with these Ticket Terms. Wristbands that are removed, transferred, altered, or appear to have been tampered with (as determined by COTALAND in its sole discretion) may be invalidated without refund.

COTALAND is not responsible for lost, stolen, damaged, or confiscated Tickets or Passes, and replacement is not guaranteed.

6. Pricing; Taxes and Fees; Payment; Chargebacks

Ticket and Pass prices, fees, and applicable taxes are determined at the time of purchase. Service fees and other charges may be non-refundable.

Third-Party Sales. Tickets/Passes may be sold or distributed by authorized third parties, each of which may impose additional terms and conditions. COTALAND is not responsible for (and may not be able to resolve) issues caused by unauthorized sellers, counterfeit tickets, or violations of third-party terms.

You agree not to initiate a chargeback or payment dispute for any Ticket or Pass except in good faith for an unauthorized transaction or as otherwise permitted by law. Improper chargebacks may result in cancellation of Tickets/Passes and denial of entry, subject to applicable law.

ALL TICKET, PASS, MEMBERSHIP, AND ADD-ON SALES ARE FINAL AND NONREFUNDABLE, and may not be exchanged or redeemed for cash, except as expressly required by law or expressly authorized in writing by COTALAND in its sole discretion. Any discretionary rebooking, replacement visit opportunity, credit, extension, or substitution (if offered) may be conditioned on additional fees, verification, and/or other requirements determined by COTALAND.

7. Park Hours; Attraction Availability; Closures; Weather

Park hours, attractions, rides, entertainment, food and beverage locations, and other offerings may vary by day and are subject to change without notice. Certain rides or attractions may be unavailable due to maintenance, weather, staffing, queue management, safety, or other operational reasons.

Restricted Access; Early Closures; Separately Ticketed Events. COTALAND may, at any time, close the Park (in whole or in part), restrict access to certain areas, limit entry/re-entry, modify operating hours (including early closure), and/or require separate admission for certain events, attractions, entertainment offerings, experiences, or areas (including after a Ticket/Pass is purchased), without refund except as required by law or expressly authorized by COTALAND in writing.

Governmental Orders; Capacity Restrictions. Without limiting the foregoing, no refund will be provided due to any closure, capacity limitation, or operational restriction resulting from any federal, state, or local law, regulation, or governmental order, except as required by law or expressly authorized by COTALAND in writing.

Tickets and Passes are generally valid rain or shine and are not eligible for refunds due to inclement weather or attraction closures; however, in the event of a full-day Park closure determined by COTALAND, COTALAND may, in its sole discretion, offer a comparable replacement visit opportunity or rebooking (no cash refunds).

8. Safety; Security Screening; Surveillance

For safety and security, all guests and personal items (including bags, purses, backpacks, packages, and strollers) may be subject to screening, inspection, and/or search at any time, and entry may be denied to anyone refusing screening or otherwise violating Park Rules.

Unattended Items; Prohibited Items. COTALAND reserves the right to prohibit any bag or item and to require that prohibited items be returned to a vehicle or otherwise removed from the premises. Unattended items may be removed, handled, or disposed of in the manner COTALAND deems appropriate for safety and operations. Prohibited items may include, without limitation, drones and other recreational devices, selfie sticks/extension poles, glass containers (except as permitted), and other items identified in Park Rules.

COTALAND uses security measures which may include surveillance cameras, facial recognition, and other monitoring technologies. You consent to such security measures as a condition of entry.

9. Code of Conduct; Revocation; Removal Without Refund

COTALAND is a family destination. Guests are expected to behave appropriately, follow posted instructions, and comply with all Park Rules. Violations may result in any or all of the following penalties, or other non-listed penalties, at COTALAND’s sole discretion: denial of entry to the Park, removal from the Park without refund, prohibition from future ticket purchase to the Park and its attractions, revocation of Annual Pass products, and bans from entry into the Park and/or the broader Circuit of the Americas campus.

Without limiting the foregoing, the following conduct is prohibited and may result in revocation of your Ticket/Pass and removal without refund:

• Threatening, harassing, discriminatory, abusive, obscene, or otherwise inappropriate language or behavior.
• Guests shall not interfere with the events, and/or exhibitors, vendors, performers, or venueor event operations or personnel.
• Fighting, reckless conduct, disorderly conduct, or any conduct that is unsafe or detrimental to other guests, employees, animals, or the Park.
• Intoxication, possession or use of illegal drugs, or misuse of alcohol; providing alcohol to minors; or failure to comply with alcohol policies.
• Smoking or vaping (including e-cigarettes) except in designated areas (if any); possession or use of cannabis/marijuana products except as permitted by applicable law and Park Rules; or any conduct that creates smoke/vapor exposure for other guests.
• Possession of weapons, fireworks, explosives, or other dangerous items; or possession of prohibited items (including, without limitation, drones, remote-controlled devices, selfie sticks/extension poles, or other items identified in Park Rules or posted signage).
• Vandalism, theft of property or services, fraud, counterfeiting, or misuse of Tickets/Passes or Reservations.
• Line-jumping or cutting; saving places in line in a manner detrimental to other guests; or failure to follow ride/attraction instructions.
• Entering restricted areas; climbing fences/barriers; tampering with safety devices; or failing to comply with safety instructions.
• Unauthorized commercial activity, solicitation, distribution of materials, or photography/videography not permitted by the Park Rules.
• Failure to follow directions from COTALAND personnel, security, or emergency responders.
• Inappropriate attire including clothing with threatening/hateful/offensive content, excessively revealing clothing, or identity-concealing face coverings (e.g., balaclavas/ski masks), except for medical, disability, religious, or weather-related reasons. Guests may be required to briefly remove face coverings for identification, screening, or admission validation.

Minors under a designated age may be required to be accompanied by a supervising adult at all times, except for programs specifically intended for minors (e.g., camps or educational programs).

COTALAND reserves the right to modify the Park Rules and Code of Conduct from time to time, with or without notice, and to interpret and enforce such rules in its sole discretion.

10. Assumption of Risk

You acknowledge that visiting and participating in activities at the Park involves inherent risks, including the risk of serious bodily injury, death, illness (including exposure to communicable diseases), and property damage. Inherent risks may include, without limitation: slips, trips and falls; ride or equipment malfunction; mechanical or operational issues; collisions; flying debris or objects; crowd-related hazards; noise; weather hazards; contact with animals (where permitted); reckless or violent acts of other guests; and the failure or unsuitability of facilities, barriers, railings, restraints, or safety systems to protect persons or property from harm. You also acknowledge that emergency response and rescue operations may be delayed or limited.

YOU VOLUNTARILY ASSUME ALL SUCH RISKS, WHETHER FORESEEABLE OR NOT, AND WHETHER CAUSED BY THE NEGLIGENCE OF ANY COTALAND PARTY OR OTHERWISE, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Release; Waiver of Claims; Indemnity

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU, ON BEHALF OF YOURSELF AND ANY MINOR(S) FOR WHOM YOU ARE A PARENT OR LEGAL GUARDIAN, HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE THE COTALAND PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, LIABILITIES, COSTS AND EXPENSES (INCLUDING ATTORNEYS’ FEES) ARISING OUT OF OR RELATED TO (A) YOUR PURCHASE, ACCEPTANCE, POSSESSION OR USE OF ANY TICKET OR PASS; (B) YOUR ENTRY INTO OR PRESENCE AT THE PARK OR THE COTALAND CAMPUS; OR (C) YOUR PARTICIPATION IN ANY PARK ACTIVITIES, ATTRACTIONS, RIDES, EVENTS OR SERVICES, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OR OTHER FAULT OF ANY COTALAND PARTY.

You agree to indemnify, defend and hold harmless the COTALAND Parties from and against any and all claims, demands, causes of action, damages, losses, liabilities, costs and expenses (including attorneys’ fees) arising out of or related to (i) your acts or omissions at the Park, (ii) your violation of these Ticket Terms or the Park Rules, or (iii) your negligence or willful misconduct, including any claim asserted by or on behalf of a minor for whom you are responsible.

If you are a parent or guardian accompanying a minor, by allowing the minor to enter the Park, you represent and warrant that you have authority to agree and consent to these Ticket Terms (including the release/waiver/assumption of risk and data collection/media consents outlined herein) on the minor’s behalf. If you do not wish to or are not authorized to grant such rights, releases, and waivers on behalf of such minor, you must not permit the minor to enter and you should promptly exit the Park with the minor.

12. Photography, Recording, and Media Rights

COTALAND may photograph, record, and/or otherwise capture images, video, and audio of guests in connection with Park operations, safety and security, ride photos, marketing, promotional materials, and other lawful purposes.

As a condition of entry, you grant the COTALAND Parties and their designees the irrevocable right to use your name, image, likeness, voice, and statements captured at the Park in any media worldwide in perpetuity, without compensation, for lawful purposes including advertising and promotion, to the extent permitted by law.

Guests may use personal devices for personal, non-commercial photography and videography unless restricted by posted Park Rules. COTALAND may prohibit or restrict recording in certain areas, on certain rides, or during certain events. Drones are prohibited unless expressly authorized in writing by COTALAND.

On-ride photography is strictly prohibited on most of our attractions without park permission unless the recording device is a glasses-based micro camera (ex: Meta Glasses) that is secured to the head with an approved strap while riding. Small action cameras, including GoPro, DJI Osmo, DJI Pocket, etc. are not permitted on rides and attractions. Please review each ride’s safety guidelines for any additional restrictions.

13. Data Collection; Biometrics; Consent

In addition to the information described in the COTALAND Privacy Policy, COTALAND may collect information while you are on the campus and/or in the Park, including through Wi‑Fi networks, mobile applications, ticketing systems, CCTV and other security systems, ride photo systems, and other operational technologies.

Biometric Information. To the extent permitted by law, COTALAND may utilize biometric technologies (including facial recognition or other measurements of face geometry) for purposes such as (i) facilitating Park entry and re-entry, (ii) validating Tickets/Passes, (iii) enabling ride photo delivery, and/or (iv) safety and security.

Where required by applicable law, COTALAND will provide notice and obtain consent before capturing a biometric identifier for a commercial purpose, will use reasonable care to protect biometric identifiers, will not sell or lease biometric identifiers, and will destroy biometric identifiers within the timeframes required by law, subject to legally permitted exceptions.

Retention; Destruction. COTALAND will retain biometric identifiers only as long as reasonably necessary to fulfill the purposes described in these Ticket Terms (and as otherwise permitted or required by law) and will destroy biometric identifiers within a reasonable time after the purpose for collection has been satisfied, but no later than one (1) year after that purpose has been satisfied, except where a legally recognized exception applies.

Security; Limits on Disclosure. COTALAND will use reasonable care to protect biometric identifiers from unauthorized access or disclosure and will not sell, lease, or otherwise disclose biometric identifiers except as permitted by law, including to service providers acting on COTALAND’s behalf under appropriate obligations, or as required by legal process.

By entering the Park and/or using any system that captures biometric identifiers, you acknowledge and consent to such collection and use to the extent permitted by law. If you are purchasing or furnishing a ticket on behalf of a minor, you consent on behalf of that minor in the same manner as you grant consent for yourself, and you represent that you have the authority to do so as a parent or guardian of that minor.

14. Food Allergies; Health; Accessibility

Guests are responsible for assessing whether Park activities are appropriate for their physical condition and for following all posted warnings and instructions. Certain rides and attractions may have height, weight, health, or other restrictions.

COTALAND will provide reasonable accommodations consistent with applicable disability laws; however, not all attractions are accessible to all guests and certain safety restrictions cannot be waived.

Service Animals. Trained service animals are permitted where required by applicable law, subject to safety restrictions and attraction-specific limitations. Pets and emotional support/comfort animals are not permitted except as expressly allowed by Park Rules or applicable law.

Food allergens may be present throughout the Park. While COTALAND may provide ingredient information upon request for certain items, COTALAND does not guarantee any food will be allergen-free and guests are responsible for their own dietary needs.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ANY COTALAND PARTY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TICKET TERMS, ANY TICKET OR PASS, OR THE PARK, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE COTALAND PARTIES FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TICKET TERMS, ANY TICKET OR PASS, OR THE PARK SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO COTALAND FOR THE SPECIFIC TICKET OR PASS GIVING RISE TO THE CLAIM.

16. Force Majeure

COTALAND is not responsible for conditions or events outside its reasonable control, including inclement weather, acts of God, governmental actions or orders, emergencies, civil unrest, labor disputes, supply chain disruptions, transportation issues, or other force majeure events. COTALAND may, in its sole discretion, modify hours, capacity, attractions, policies, and operations in response to such events. UNLESS AND TO THE EXTENT REQUIRED BY LAW OR OTHERWISE PERMITTED BY COTALAND, YOU ARE NOT ENTITLED TO A REFUND, REPLACEMENT TICKET, OR TO PAYMENT FOR DAMAGES OF ANY KIND FOR ANY REASON, INCLUDING WITHOUT LIMITATION THE DELAY, POSTPONEMENT, CANCELLATION, SHORTENING, RESTRICTION, OR ANY OTHER ALTERATION OF THE RIGHTS PROVIDED BY A TICKET TO THE PARK OR ANY ATTRACTION, INCLUDING BUT NOT LIMITED TO FOR REASONS OF FORCE MAJEURE AS PROVIDED IN THIS SECTION.

17. Dispute Resolution; Governing Law; Venue

Governing Law. These Ticket Terms are governed by the laws of the State of Texas, without regard to conflicts of laws principles.

Dispute Resolution. Any dispute arising out of or related to these Ticket Terms shall be resolved pursuant to the dispute resolution provisions (including any arbitration agreement and class action waiver) set forth in the COTALAND Website Terms of Use, which are incorporated herein by reference as if fully set forth in these Ticket Terms.

If the above dispute resolution procedures are deemed inapplicable or unlawful for any reason, COTALAND may instead designate an exclusive venue in Travis County, Texas (state or federal courts) for disputes not subject to mandatory arbitration, subject to applicable law.

Time Limit to Bring Claims. To the maximum extent permitted by law, any claim arising out of or related to a Ticket, Pass, Reservation, the Park, or these Ticket Terms must be brought within one (1) year after the event giving rise to the claim, or such claim is permanently barred.

18. Changes to Ticket Terms

COTALAND may modify these Ticket Terms at any time. Updated versions will be posted on the COTALAND website or otherwise made available. The Ticket Terms in effect at the time you purchase a Ticket or Pass will generally apply to that transaction; however, updated Park Rules, safety requirements, and operational policies may apply at the time of entry.

20. Miscellaneous

Severability. If any provision of these Ticket Terms is held unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect.

No Waiver. No waiver of any breach will be deemed a waiver of any other breach.

Headings. Headings are for convenience only and do not affect interpretation.

Survival. Sections relating to assumption of risk, release/waiver/indemnity, limitation of liability, dispute resolution, biometric/data provisions, and any other provisions that by their nature should survive will survive termination or expiration.
